BRAVECTO INJECTABLE CRYSTAL CLEAR GUARANTEE TERMS AND CONDITIONS

  1. The Crystal Clear Guarantee (the “Guarantee”) is provided and administered by MSD Animal Health UK Limited, company number: 00946942, with a registered office address at: Walton Manor, Walton, Milton Keynes, Buckinghamshire, MK7 7AJ (“MSD”) and is composed of two schemes, the Practice Guarantee and the Pet Owner Guarantee.  The Guarantee is available to veterinary practices who have purchased BRAVECTO® injectable from MSD (individually referred to as a “Customer”).  The Guarantee is between MSD and the Customer and is subject to the terms and conditions expressed below.


  2. Practice Guarantee. Under the scheme, a Customer veterinary practice that has purchased BRAVECTO injectable from MSD is covered for a single episode of accidental vial breakage or incorrect vial mixing. Individual practice training and a replacement vial or partial refund for unused product will be provided in the event of product wastage as a result of misuse.   Training and support in the event of additional episodes will be at MSD’s discretion.  In order to claim under this Practice Guarantee the Customer needs to file a report by filling out Form A, online, as required. 

     
  3. Pet Owner Guarantee. The Pet Owner Guarantee is available to Customers to claim on behalf of their clients who are residents of Great Britain, the Channel Islands and the Isle of Man, aged 18 years or over, and whose dog has been administered a full dose of BRAVECTO® injectable at a participating Customer’s veterinary practice (each individually referred to as a “Client”). The participating Customer practice will submit and manage any claim on behalf of the Client.  To be eligible the Customer and Client must comply with the terms and conditions expressed below. Clients supported by the Pet Owner Guarantee must have at least one dog on treatment with Bravecto injectable by the Customer.  All pets in the household must be in-date for veterinary prescribed flea and tick treatment and have had been dispensed 12 weeks of Bravecto or an alternative licensed veterinary prescribed spot-on or chew product e.g. a monthly spot-on.

     
  4. If in the opinion of the Customer’s consulting veterinary surgeon further treatment of the Client’s dog is required to effectively manage a flea or tick infestation during the period of efficacy and within 12 months of the administration of BRAVECTO injectable, a Client will be entitled to an additional free of charge follow up consultation by the Customer, (and, at MSD’s discretion, relevant diagnostics and additional specific definitive treatment) for the treated dog up to a maximum value of £200. 

     
  5. In order to claim under this Pet Owner Guarantee the Customer’s consulting veterinary surgeon needs to file a report by filling out Form B, online, as required. Prescription of all relevant flea and tick treatments should be evidenced by uploading the appropriate veterinary practice proof of purchase before conducting a full consultation with the Client. 

     
  6. The decision to support the costs of additional treatment is at the sole discretion of the MSD veterinary advisor. Additional treatment must be prescribed by the Customer’s veterinary surgeon. At MSD’s discretion, coverage of costs may include household products such as sprays.

     
  7. A claim must be filed by the Customer’s veterinary practice within 12 months of the administration of BRAVECTO injectable to the Client’s dog.

     
  8. Claims are limited to one per Client dog and an individual Client or Client household may make up to a maximum of 5 claims under the Pet Owner Guarantee.

Conditions of Guarantee:

  1. The Practice Guarantee is supported with free of charge product and training provision, whereas the Client Guarantee is supported by way of an invoice from the Customer practice in relation to agreed costs corresponding to the Client. No cash alternative is available.

     
  2. On receipt of a valid claim under the Pet Owner Guarantee MSD shall refund the costs charged to a Client by the Customer for the Client’s consultation plus those reasonable diagnostic/treatment fees that have been agreed in principle by MSD’s veterinary advisor. This shall be the sole remedy available to the Customer or the Customer’s Client under the Pet Owner Guarantee.  Nothing in these terms and conditions shall limit or exclude liability which cannot be limited or excluded by law.

     
  3. A Client’s statutory rights are not affected by this Pet Owner Guarantee.

  4. No correspondence will be entered into between MSD and any Client.  The Client is not a party to the Pet Owner Guarantee. 

     
  5. MSD reserves the right, at its absolute discretion, to amend or suspend this Guarantee or withdraw the Guarantee or a part thereof in relation to a particular veterinary practice at any time with no liability to any participants, veterinary practices or third parties.

     
  6. This Guarantee and terms and conditions are governed by English Law and the courts of England shall have exclusive jurisdiction over any dispute arising out of or in connection with this offer.  The parties irrevocably submit the jurisdiction of the courts of England and Wales to resolve any dispute arising out of or in connection with the Guarantee.  

     
  7. Nothing in these term and conditions is intended to confer on any person any right to enforce any term of this agreement which that person would not have had but for the Contracts (Rights of Third Parties) Act 1999. 

     
  8. By submitting a claim, Customers agree to be bound by these terms and conditions.
